Two kinds of divorce paper

Italy ends marriages in more than one way, and the paper differs. A judge may rule, or the couple may sign before the mayor after lawyers have agreed the terms. The two produce different papers, and they take different routes. So how to legalize a Divorce Decree depends first on which of the two you hold.

A ruling from the Tribunale

A judge's ruling is a judicial act. The clerk's office at the Tribunale issues a certified copy, and the Procura della Repubblica at that same court adds the stamp. Ask the clerk for a copy marked for use abroad, so the sheets are joined and sealed. That is the route to legalize a Divorce Decree in Florence when a judge decided it.

A record from the town hall

A divorce signed at the town hall is an administrative record. The registry issues the extract and the Prefettura, the state's provincial office, puts the stamp on. It never goes to the Procura, because no judge and no notary made it. The consular legalization of a Divorce Decree in Italy follows whichever of the two offices made your paper.

Proof that it is over

Whichever paper you hold, a reader abroad wants to know the divorce is settled and not under appeal. For a court ruling that is a second sheet from the clerk. For a town-hall record it is the note added to the marriage entry, which the registry can print for you. Ask for it in the same visit and save yourself a return trip.

Fee and timing

The state side takes a €16 marca da bollo, bought at a tobacconist. The clerk's office or the registry charges for the copy itself, at its own rate. The mission of the receiving country then adds a fee it sets alone. Count on 10–15 business days, or 3–5 if you pay for the express route. The embassy legalization of a Divorce Decree in Florence usually sets the pace.

Remarrying outside Italy

Most people order this to marry again outside Italy. The registrar at the far end wants the divorce paper, often with a statement that nothing blocks the new marriage. Some also want the marriage record with the note on it. Ask for the full list on paper before you start, since ordering the sheets one at a time doubles the wait.

Check the route before you start

Nobody in Florence can tell you whether a mission's stamp is needed. That answer belongs to the country reading the file, so ask the receiving authority and keep the reply. Some registries take a single-step certification and go no further. An embassy attestation of a Divorce Decree in Florence is only worth buying once you know it is wanted.
